Segundo o relator, o valor “fica garantido, mas não pode sofrer novos impactos”. O fundamento foi o Tema 23 do TST, que aplica a Reforma de forma imediata aos contratos em andamento. O entendimento separa os dois momentos. O que foi adquirido pela regra antiga fica preservado, e o que aconteceu depois da Reforma segue a lei nova. A decisão foi unânime, com ressalvas de três ministros, e é o primeiro caso da SDI-1 sobre esse ponto, o que torna o acórdão uma referência para processos semelhantes.
